About STIKKLING

The STIKKLING website stikkling.com (“site”) is run by STIKKLING AB (company number. 559276-3758), a company established in Sweden (Bergevägen 16, 829 60 Gnarp, Gävleborg County) (“STIKKLING”, “we”, “our” or “us”). We are committed to protecting and respecting your privacy.

STIKKLING works to enable safe and fun peer-to-peer plant (or plant related) sales. We provide a social-media inspired marketplace where users can buy and sell items, communicate with each other, manage shipments and payments etc. which you can access through our website (“service”). You can search for items, log-in to your profile and view other profiles (each shop/seller has a unique public URL) via the website. When you use our site or service we will collect and process certain information about you. This privacy policy sets out how STIKKLING collects, uses and shares information that identifies you or is associated with you (“personal information”). Our main goal in collecting such data is to provide you with a safe, efficient and personalized experience, and we will only collect information relating to you that we deem necessary for this purpose.

By creating an account you are accepting the privacy policy you agree to share your personal data and consent to our collection, use, disclosure and retention of your personal data as described in this privacy policy and in our terms of use. You also consent to the transfer and storage of that information on our services located in Frankfurt or elsewhere in the world, such as in the United States.

STIKKLING’s role as a controller

STIKKLING cares about your privacy and takes all necessary measures to make sure your personal data re being processed by us in a lawful, fair and transparent manner. All personal data processed by us is processed in accordance with applicable law, including the General Data Protection Regulation (the “GDPR”), supplementary national legislation, as well as practices, guidelines and recommendations insured by a national or EU supervisory authority (“Applicable law”). In this policy we describe how and the purposes for which we use your personal data as well as what lawful basis we use and what measures we take to protect Personal Data. We also provide information on how you may exercise the rights you have linked to processing of your personal data.

As part of our business STIKKLING processes personal data for which STIKKLING is the controller. This means that STIKKLING is responsible for ensuring that the processing of your personal data is varied out in accordance with applicable law and this privacy policy. We decide the purpose of and the means for the processing (what methods, what personal data and for how long it is stored).

This privacy policy covers all necessary information about our personal data processing when you communicate with us, collaborate with us, participate in or make use of the service or visit our site. It is important to us that you feel comfortable with how we process personal data and it is important that you read and understand this privacy policy before you use any of our services. WHAT PERSONAL DATA DO WE COLLECT AND WHERE FROM?

We collect the following types of information, including personal data, in order to provide you with the use of and access to our site, services and tools, to help us personalize and improve your experience and for our advertising purposes.

The personal data we may collect may, depending on the context and the nature of your request or application, include:

  • your full name, contact information, such as your address, telephone number, or email address and (depending on the service used) sometimes financial information, such as bank account numbers;
  • additional information you may provide to us via social media sites or services;
  • photographs or videos you may upload to our site during the use of our service;
  • transactional information based on your activities on the site (such as bidding, buying, selling, review, item and content you generate or that relates to your account);
  • shipping, billing, payment and other information you provide to purchase or ship and item as well as, where shipping services are provided through one of our integrated systems, additional relevant shipping information (tracking updates) stored by the chosen partner;
  • information provided in the context of community discussions, comments, in-site messaging, dispute resolution, correspondence through our sites, or correspondence sent to us. We will also record comments and opinions you express when responding to surveys, entering competitions or taking part in promotions we run;
  • additional documents we may ask you to submit to authenticate yourself or if we believe you are violating site policies. For example, we may ask you to send us a government issued identity document or other documentation to verify your identity or address, or to answer additional questions to help verify your identity or ownership of an item you list); and
  • information about the computer, tablet, smartphone or other electronic device you use to connect to our service such as geographical location, type of device, browser and IP address.
  • information about how you use our site and service such as the pages you view on our site and service, the time you access our site and service and how long you use it for, the website from where you came to our site or go to after leaving our site (if applicable) and any selections and choices you make when using our site and service.
  • information about the preferences you set for notifications, marketing communications and how our site is displayed or what content is displayed to you through our service. We will use your preference settings for the purpose of providing
  • sign in credentials. When you create an account with us we will hold your sign in credentials in the legitimate interests of keeping your account secure. Where you are provided with the option to log-in using a social network, for example through Facebook sign- in, we will not be provided with your password or other account login details for those accounts.

USE OF PERSONAL DATA

STIKKLING may use your personal data for the following purposes and based on the following legal grounds:

  • Legitimate interests:
    • Communication: for us to be able to communicate with you directly about the products you purchase and that you sell through the service and about queries, issues or concerns you or other users have, we process the personal data you provide us with such as telephone number, social media account and email address.
    • Technical issues: to be able to detect, prevent and address technical issues with our digital services such as the application system, the administrative system and the sites
    • For marketing purposes: in order for us to market our service the best way possible and reach as many potential customers as possible we use your personal data.
    • Analytics and statistics: to be able to improve and develop our services, we process your personal data such as the usage of our services for analysis, such as application patterns. The purpose of this is to evaluate our service, oversee our processes and follow up and improve offerings and campaigns.
  • Compliance with a legal obligation:
    • We process your personal data in order to comply with legal obligation to which we are subject. This entails that we e.g. save invoices and payments according to the Swedish Accounting Act.

By using the payment services provided by Stripe, you authorize STIKKLING to pass to Stripe any information and payment instructions you provide (which may include name, email address, unique customer identifier, order ID, bank account details, payment card details, card expiration date, CVC code, date/time/amount of transaction, merchant name/ID and location) to the extent required to complete payments via the service.

We may access and review personal data such as messages to assist in the fulfilment of orders made through the service, to respond to any query, issue, concern or dispute users raise and to resolve such disputes and if we have reason to believe the messages may contain evidence that you have breached our terms of service.

Certain information will also be visible to search engines, including but not limited to the photos that you post. We may provide third parties with aggregate statistical information and analytics about users of the service but we will make sure that no one can be identified from this information before we disclose it.

RETENTION OF PERSONAL DATA

STIKKLING takes all reasonable steps to ensure that your personal data is processed and stored securely. We will never store your personal data longer than necessary for the purposes for which it was collected or than what is permitted by applicable law. Your personal data will be processed by us during the following set time periods or the time determined by the criteria defined below, after which the personal data will be deleted or changed in to a form that does not identify you:

  • Users: If you have an account with us your Personal Information will be kept by us for as long as your account remains active. If you deactivate your account, or we deactivate it due to a prolonged period of inactivity on your part, your personal information will be kept for a reasonable period of time after this so that we can complete any activities already initiated or where we have a need to retain your personal information for legal or technical reasons (including back-up systems) for example to retain proof of transactions for the enforcement of our rights, and to enable the other party to a transaction to access records of past purchases or sales.
  • Communication: If you are in contact with us by email for example, your personal data are saved for as long as it is necessary for us to answer your questions and complete any follow-up inquiries;
  • Consent: In the event that we process your personal data based on your consent we only save your personal data for as long as we still have your consent.

INFORMATION AVAILABLE TO OTHER USERS THROUGH THE SERVICE

Personal data shared with other users

The service is designed to help you interact with other users of the service. As a result of this some of the information generated through the service is shared with other users of the service For example, where you are involved in a transaction with another user, the other user may view your email address and request and obtain your contact information and postal address to help complete the transaction.

STIKKLING enables you to share personal and financial information to complete transactions and collect payments. We encourage you to disclose your privacy practices and respect the privacy of other users. We cannot guarantee the privacy or security of information that you choose to share with other users and partners and therefore we encourage you to evaluate the privacy and security policies of your trading partner before entering into a transaction and choosing to share your information. To help protect your privacy, we allow only limited access to other users’ contact, shipping and financial information to facilitate your transactions and collect payments. In all cases, you must give other users a chance to remove themselves from your database and a chance to review what information you have collected about them.

You agree to use another user's personal data only for:

  • STIKKLING transaction-related purposes that are not unsolicited commercial messages;
  • using services offered through STIKKLING (such as payment, shipping, delivery and fraud complaints); or
  • specific purposes to which the user expressly chooses or consents to.

User profile

When you create an account on the service a user profile will be generated for you that makes the following information publicly available: user name, country and city location, your followers and who you are following, details about the items you are selling, ratings and reviews. If you add any of the following information to your profile this will also be made publicly available: profile picture, profile description, social media account and website address.

Item listings

When you list an item for sale on the service information you add to the listing will be made publicly available such as the item photograph, price, item description, accepted payment method and delivery options. Any comments or likes other users add to your item listing will also be made publicly available as well as any reply comments or images you post. Other users may also share a link to an item they have bought from you via the service on other social media channels which link to the service, but this will not result in any information that was not already public, being made public.

Information about your activity on the service 

Some of your activities on the services are public by default. These activities are when you follow a user, or a user follows you, when you comment on or like an item, when you list an item for sale, when your item is sold, when you purchase an item, your ratings and your reviews.

TRANSFER OF PERSONAL DATA TO THIRD PARTIES

STIKKLING only transfers personal data as described below. We always observe great caution when transferring your personal data and your personal data is only transferred in accordance with this privacy policy and after taking appropriate security measures. We do not sell personal data to third parties. STIKKLING may transfer your personal data in the following situations:

  • Service providers. Third parties who provide a service to us. These third parties will only be allowed to use your personal information in accordance with our instructions and will be required to keep you information secure. The third parties we may share the personal information you provide to us are including, but not limited to, shipping providers (where you have chosen to user their service), third party payment providers (for the purposes of processing any sales transactions you have consented to) and site or service analytics providers.
  • Business transactions. If all or part of our operations is sold or integrated with any other business, operation or company, your personal data may be disclosed to our advisors, potential buyers and their advisors, and be transferred to the new owners of the operation.
  • Cookies and other technological means. If you allow cookies and other technological means when you visit the sites, any personal data collected about you and your behavior on the sites may be collected by using cookies or other similar techniques.
  • Legal obligations. Your personal data may also be disclosed for the purpose of STIKKLING's compliance with certain legal obligations and it may be transferred to the Police and other relevant public authorities when permitted and required by law.

SECURITY MEASURES

The security of your personal data is important to us. We protect your personal data by maintaining physical, organizational and technological safeguards appropriate to the sensitivity of such personal data. Personal data may only be accessed by persons within STIKKLING who require such access to carry out our purposes as described above. Some of the safeguards we use are data encryption and information access authorization controls.

COOKIES AND OTHER TECHNOLOGICAL MEANS

We use cookies on our sites. A cookie (or other similar technologies like pixels/beacons) is a small data file that is placed on your browser or the hardware of your computer or other device to allow a website to recognise you as a user when you return to the website, either for the duration of your visit (using a “session cookie”) or for repeat visits (a “persistent cookie”). Similar technologies work in the same way and when we use the word ‘cookie’ in this section, we refer to all technological means that collect information in this way.

We collect this information to better understand how visitors use our site, to improve the content of the site and to improve your interaction with the site by making it easier for you to get back to the pages you have looked at the next time you visit. When you first visit our sites, cookies that are strictly necessary for the sites to function are automatically set on your device. For instance, when you visit our sites for the first time, we present you with a cookie notice requesting your consent to our use cookies. In order for us to remember your cookie preferences we need to use a cookie, and since that cookie is strictly necessary for the site to function properly, it is automatically activated.

All other types of cookies we wish to use, i.e. cookies that are non-essential, requires your consent. If you do not provide your consent [by selecting the “Allow Cookies” alternative in the cookie notice], we will not set these cookies on your device.

Apart from non-essential cookies, the following types of cookies are used on the sites:

  • Functionality cookies. These cookies improve the functionality on the sites they may be set by us or by third party providers whose services we use on the sites. If you do not allow these cookies, some or all of these services may not function properly.
  • Performance/analytics cookies. These cookies make it possible for us to analyse visits on our sites, so that we can measure and improve the sites performance. If you do not allow these cookies we will not know when or how your device have visited the site and will not be able to monitor the sites’ performance.

YOUR RIGHTS

STIKKLING is committed to handle any request, complaint or concern that you may have about our use of your personal information in a fair and transparent way.

You have the right to get a transcript of the personal information that STIKKLING holds about you free of charge. You can request to obtain a copy of your personal data by sending a signed written request through the contact details stated under “Contact us” below. Should you demand a second transcript within 12 months from your previous request, we could ask for a fee to cover the costs related to administering your request.

You may ask us to make any necessary changes to ensure that the data we hold about you is complete, accurate and kept up to date. For the protection of your privacy and personal data, we may require that you identify yourself in connection with our assistance. We rely on you to ensure that your personal information is complete, accurate and up to date. Please keep us informed if your personal information changes during your relationship with us by contacting us via details stated under “Contact us” below.

Deletion of personal data

In accordance with applicable law, you also have the right to request that your personal data be erased or that the processing of your personal data be restricted. In certain situations, you also have the right to object to the processing of your personal data and request that your personal data be transmitted in an electronic format.

You can exercise your right to delete certain personal information about you by closing your account with us or terminating other involvement with STIKKLING activities, at which point all information connected to you will either be deleted or anonymised although we may need to keep some information about you in accordance to fulfill any of the purposes explained above.

Complaints

You may file a complaint with the Swedish Authority for Privacy Protection (Sw. Integritetskyddsmyndigheten) if you believe that our processing of your personal data is not carried out in accordance with applicable laws. CHANGES TO THE PRIVACY POLICY

Please note that the terms of this privacy policy may be changed or amended at any time, in order that it accurately reflects the regulatory environment and our own data collection and disclosure practices. The privacy policy published on the sites will always reflect the most recent version. Consequently, you should review these terms on a regular basis to make sure that you are satisfied with the changes. In case of any material changes we will update the “last updated” date at the top of this privacy policy. Changes to this privacy policy are effective when they are posted on this page.
